Terms of sale

1. Purpose

These terms govern the sale of the services offered by Shane Darren SAWMYNADEN, sole trader ("Optimisys"): profile analysis, structuring, support and the provision of internal software.

2. Price

The service is offered at the single price of €297, with no subscription. The price is shown at the time of order. VAT not applicable, article 293 B of the French Tax Code (CGI) (VAT small-business exemption).

3. Order and payment

The order is confirmed after online payment through our secure payment provider Stripe. Payment is made in a single instalment. A confirmation is sent by e-mail.

4. Performance of the service

As soon as payment is confirmed, the analysis begins and access to the questionnaire is opened to you. The deliverables and support are provided in accordance with the terms presented on the website.

5. Right of withdrawal and "satisfied or refunded" guarantee

In accordance with articles L221-18 et seq. of the French Consumer Code, the consumer is in principle entitled to a 14-day period to withdraw. As the service is digital content executed immediately, you expressly request its performance upon payment and waive this period (art. L221-28).

In return, Optimisys offers you a satisfied-or-refunded guarantee: if the service does not suit you, you may request a full refund within 7 days following your payment, by writing to optimisys.io@gmail.com.

6. Customer obligations

The customer undertakes to provide accurate information and to cooperate in good faith in the proper performance of the service.

7. Liability

Optimisys is bound by an obligation of means (best-efforts obligation). The service aims to structure and support your project; it does not guarantee a commercial result, which depends on many external factors. Optimisys's liability shall not exceed the amount paid.

8. Personal data

The processing of data is described in the Privacy policy.

9. Governing law and disputes

These terms of sale are governed by French law. In the event of a dispute, an amicable solution will be sought as a priority. Failing this, the French courts shall have jurisdiction.
